To the Saratoga County Board of Supervisors

We; the undersigned taxpayers are writing to demand the immediate termination of County Administrator Spencer Hellwig, Human Resources Director Marcy McNamara, and County Attorney Stephen Dorsey for gross incompetence and/or willful misappropriation of County funds for personal, political and financial gain.

We believe the so called “Covid 19 Committee” consisting of the above conspired to abuse the power afforded to them by the Board of Supervisors in response to the Covid-19 crisis. Now the external investigation from Jones, Hacker & Murphy clearly shows they did not have the right to raise pay, illegally handled County employees and repeatedly lied and/or showed gross incompetence.

On March 17, 2020 during a law and finance committee meeting of the County Board of Supervisors Marcy McNamara, County Director Human Resources, in presence of County Administrator and other Board Members claimed that County employees may “fake sick” during the crisis, and that a 50% pay raise was needed to keep them coming in to work. All members of the Covid-19 Committee, with the exception of the Supervisors, were eligible for the raise, as were other elected officials.

It has been determined this was unlawful.

Furthermore, it has been confirmed by the outside investigation that the Covid-19 Committee enacting the pay raise did so unilaterally, and in secret. The committee took no notes, kept no minutes and violated Open Meetings Law , as the public was afforded its right to attend or comment during these meetings.

To add insult to injury, the actions of this committee have exposed the tax payers of Saratoga County to significant risk of legal action from the various unions representing County employees.

WHEREAS, Spencer Hellwig, Marcy McNamara, Stephen Dorsey and various County Supervisors were given emergency powers by the Board of Supervisors which they immediately used without input from the public, and

WHEREAS , This action was in violation of Open Meeting Law and without a reasonable business case, andSara

WHEREAS, Once the public and other Supervisors rebuked this unreasonable and illegal action Hellwig, McNamara and Dorsey repeatedly lied, both overtly and by omission, and asked others to lie as detailed in the independent report as to the facts of the situation, and

WHEREAS, The residents of Saratoga County and, by extension, the Board of Supervisors can no longer trust the judgement of Hellwig, McNamara and Dorsey, and

WHEREAS, The above serve at the pleasure of the Board of Supervisors.

NOW THEREFORE BE IT RESOLVED :

That the Saratoga County Board of Supervisors should immediately vote to terminate Administrator Spencer Hellwig, Attorney Stephen Dorsey and Human Resources Director Marcy McNamara as County Employees and ban them from further employment by the County Government, and

That the Saratoga County Board of Supervisors should immediately vote to censure Supervisors Allen of Day, Wood of Saratoga and Pemerick of Greenfield for gross incompetence and misappropriation of County funds for personal and political enrichment, and

That the Saratoga County Board of Supervisors should immediately vote to censure Supervisor Lawler of Waterford for attempting to cover up blatant corruption by Saratoga County Leadership and issuing a biased and misleading report on this matter.
